外国人想要在中国工作，经常需要提的到一个词就是“工作签证“。拥有了”工作签证“，外国人就可以合法在中国进行工作。但这里提到的”工作签证“，其实是包含外国人工作许可和外国人工作类居留许可两个证件在内的一种通俗的说法。但正是这种说法，导致很多外国人甚至是国内的企业都产生误解，认为外国人办理了Z字签证入境就可以直接在中国工作，从而导致企业和外国人受到非常严厉的处罚。

外国人有下列行为之一的，属于非法就业:
(1) Working in China without obtaining a work permit or a work-type residence permit in accordance with regulations;
（一）未按照规定取得工作许可和工作类居留证件在中国境内工作的；
(2) Working in China beyond the scope of the work permit;
（二）超出工作许可限定范围在中国境内工作的；
(3) Foreign students who violate the regulations on the administration of work-study and work in China beyond the prescribed post scope or time limit.
（三）外国留学生违反勤工助学管理规定，超出规定的岗位范围或者时限在中国境内工作的。
In other words, if a foreigner only holds a Z visa and works directly in a company, he or she is considered to be in illegal employment.
