(1) Be established according to law with actual business premises, tax payment, social insurance payment, and no serious violation of law and dishonesty; the posts shall be those with special needs and not violating relevant state regulations; the wages and salaries shall not be lower than the local minimum wage standard.
(1) 依法设立,有实际经营场所、依法纳税、缴纳社会保险、无严重违法失信记录;聘用外国人从事的岗位应是有特殊需要,国内暂缺适当人选,且不违反国家有关规定的岗位;支付所聘用外国人的工资、薪金不得低于当地最低工资标准。
(2) If the laws and regulations shall be pre-approved by the competent department of the industry, the approval shall be required.
(2) 法律法规规定应由行业主管部门前置审批的,需经过批准。
2. Basic conditions of the applicant
2.申请人基本条件
(1) They shall be at least 18 years of age, be in good health, have no criminal record, have a definite employer in China, and have the necessary professional skills or appropriate knowledge level for their work.
(1) 应年满18周岁,身体健康,无犯罪记录,境内有确定的用人单位,具有从事其工作所必需的专业技能或相适应的知识水平。
(2) The work is in line with the needs of China's economic and social development and is urgently needed professionals in China.
(2) 所从事的工作符合我国经济社会发展需要,为国内急需紧缺的专业人员。
(3) Where there are other provisions in laws and regulations on foreigners working in China, such provisions shall prevail.

(4) Under any of the following circumstances, they may directly apply for a work permit for foreigners in China within China:

① Foreign high-end talents who have entered China with other visas or valid residence permits (Class A);
①持其他签证或有效居留证件已入境的外国高端人才(A类);
②Foreigners working in China change their employers, but the job position (occupation) has not changed, and the work-type residence permit is within the validity period;
②在华工作的外国人变换用人单位,但工作岗位(职业)未变动,且工作类居留许可在有效期内的;
③Foreign spouses or children of Chinese citizens, spouses or children of foreigners who permanently stay or work in China, who hold valid visas or residence permits within the valid period;
③中国公民的外籍配偶或子女、在华永久居留或工作的外国人的配偶或子女,持有效签证或在有效期内的居留许可的;
④In line with the relevant preferential policies of the free trade zone and the comprehensive innovation and reform pilot zone;
④符合自由贸易区、全面创新改革试验区相关优惠政策的;
⑤The employer meets the relevant preferential policies of the headquarters of multinational companies in China;
⑤用人单位符合享有跨国公司在华地区总部相关优惠政策的;
⑥Movement of personnel within the enterprise group;
⑥企业集团内部人员流动的;
⑦Implementation of intergovernmental agreements or agreements;
⑦执行政府间协议或协定的;
⑧Representatives of resident offices in China on work visas; foreigners who have obtained the work permit to work in China for less than 90 days and are employed by domestic employers within the term of their stay;
⑧已持工作签证依法入境的驻华机构代表人员;已获得来华工作90日以下的外国人来华工作许可,在其停留有效期内,被境内用人单位依法聘用的;
⑨In recent 5 years, continuously working legally in China for more than 1 year and with good credit (including 1 year);
⑨近5年内,连续在华合法工作1年以上且信用良好的(含1年);
⑩Other examination and approval agencies determine to meet the conditions.
⑩其他审批机构认定符合条件的。
(2) The required materials

1. Application form for work permit for foreigners in China: fill in and print online, and after the signature of the applicant, stamp the official seal of the employer or the official seal of the authorized department and upload it to the system.
1.外国人来华工作许可申请表:在线填写打印,申请人签字后,加盖用人单位公章或经单位授权部门公章上传至系统。
2. Accreditation materials for foreign talents: According to the "Classification Standards for Foreigners' Work in China (Trial)", relevant certification materials that meet the accreditation requirements shall be provided. The applicant shall sign the application form and stamp the application form with the official seal of the employer, and agree to the licensing decision agency to conduct supplementary investigation according to the needs.
2.外国人才认定材料:应根据《外国人来华工作分类标准(试行)》,提供符合认定条件的相关证明材料,由申请人在申请表中签字并加盖用人单位公章,同意许可决定机构根据需要进行补充调查。

通过计点积分达到外国高端人才(A类)或外国专业人才(B类)标准的,应提供相应的最高学位(学历)证书、职业资格证明、汉语水平能力(中国汉语水平考试HSK证书等)、来华工作年薪的收入证明、工作资历证明材料以及计点积分表等材料。

在涉及薪资事项申请时,应提交单位及申请人承诺书(承诺事项包括外国人的月薪(年薪)、在沪月(年)交税金额、缴税地点等,申请人签字,用人单位加盖公章),受理及决定机构可要求用人单位在办理下次业务时提供相应税单。
3. Qualification certificate: issued by the applicant in the original work unit and employment related work experience certificate, including position, working hours or ever done project, need the applicant work unit with official seal or head of the signature, and have proof contact valid contact phone number or email. Applicants who meet the standard of foreign talents with point points should provide a certificate of work experience that meet the number of points. Foreign high-end talents (Class A) that meet the Classification Standards for Foreigners to Work in China (Trial) (1) those selected in the domestic talent introduction plan; (2) foreign high-end talents that meet the internationally recognized standards for professional achievement should adopt the commitment system; other talents who meet the foreign high-end talents (Class A) should still provide proof of working qualifications. If the applicant wins a well-known award in the professional field, the corresponding award proof materials can be provided.
3.工作资历证明:由申请人原工作过的单位出具从事与现聘用岗位工作相关的工作经历证明,内容包括职位、工作时间或曾经做过的项目,需申请人原工作单位加盖公章或负责人签字,并留有证明联系人有效联系电话或电子邮件。符合计点积分外国人才标准的申请人需出具满足积分年限的工作经历证明。符合《外国人来华工作分类标准(试行)》外国高端人才(A类)(一)入选国内人才引进计划的;(二)符合国际公认的专业成就认定标准的外国高端人才,该项采用承诺制;其他达到外国高端人才(A类)标准的仍需提供工作资历证明。如申请人在专业领域知名奖项获奖,可提供相应获奖证明材料。
4. Certificate of highest degree (degree) and certification materials: the highest degree (degree) certificate shall be obtained by our embassy or consulate or by the applicant; the highest degree (degree) certificate in Hong Kong, Macao and Taiwan shall be certified by China or notarized by the local notary office; if the highest degree (degree) certificate is obtained in China, only the original certificate of academic degree (degree) shall be provided. Foreign high-end talents (Class A) (1) who meet the Classification Standard for Foreigners in China (Trial); (2) meet the internationally recognized standards for professional achievements; (3) foreign talents who meet the requirements of market-oriented encouraged positions; (4) innovative and entrepreneurial talents shall adopt commitment system.
4.最高学位(学历)证书及认证材料:最高学位(学历)证书在国外获得的,应经我驻外使、领馆或由申请人获得学位(学历)所在国驻华使、领馆或我国学历认证机构认证;最高学位(学历)证书在港澳特别行政区和台湾地区获得的,应经我国学历认证机构认证或经所在地区公证机构公证;最高学位(学历)证书在中国境内获得的,仅提供学历(学位)证书原件。符合《外国人来华工作分类标准(试行)》外国高端人才(A类)(一)入选国内人才引进计划的;(二)符合国际公认的专业成就认定标准的;(三)符合市场导向的鼓励类岗位需求的外国人才;(四)创新创业人才的,该项采用承诺制。
5. Relevant approval documents and professional qualification certificate: According to the laws and regulations of the country or have the corresponding professional qualification, the certificate shall be provided; the foreign professional qualification certificate shall be certified by the embassy or consulate, or the original of the certificate. If the professional qualification certificate is obtained in the Hong Kong, Macao Special Administrative Region and Taiwan [A1], the original shall be notarized by the local notary office [A 1].
5.相关批准文书、职业资格证明:我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的,应提供行业主管部门批准文书或职业资格证明;国外专业资格证明,应经我驻外使、领馆认证,或获得专业资格证明所在国的驻华使、领馆认证或公证机构对原件公证;职业资格证明在港澳特别行政区和台湾地区[A1] 获得的,应经所在地区公证机关对原件公证。
6. No criminal record certificate and certification materials: foreign high-end talents (Class A) and foreign scientific and technological talents shall adopt the commitment system.
6.无犯罪记录证明及认证材料:外国高端人才(A类)和外国科技人才该项采用承诺制。
Foreign professionals (category B) shall be issued by the police, security and court departments of the applicant's nationality or habitual residence and certified by our embassies or consulates or foreign embassies or consulates (habitual residence refers to the country or region where the applicant has left the country of nationality for more than one year, not including China); the certificate of no criminal record issued in the Hong Kong and Taiwan region shall be notarized by the local notary office. No criminal record should be issued within 6 months. Do not accept a sworn no criminal record with no criminal record. Non-oath without criminal records issued by foreign affairs (including foreign embassies and consulates in China) can be received directly and no longer certified. In principle, the work residence permit may be exempted from providing proof of no criminal record; if the entry-exit agency has cancelled the work residence permit and replaced the stay visa; if the foreigner has not left the country, the proof of no criminal record of the work residence permit may be exempted within one month.
外国专业人才(B类)应当由申请人国籍国或经常居住地警察、安全、法院等部门出具,并经我驻外使、领馆认证或外国驻华使、领馆认证(经常居住地指申请人离开国籍国最后连续居住1年以上的国家或地区,不包括在中国境内);在港澳特别行政区和台湾地区出具的无犯罪记录证明,应经所在地区公证机关公证。无犯罪记录签发时间应在6个月内。不接收仅为本人声明无犯罪的宣誓性无犯罪记录。外交(含外国驻华使、领馆)出具的非宣誓性无犯罪记录可直接接收,不再认证。原则上,工作类居留许可在有效期内可以免提供无犯罪记录证明;如外国人更换单位,公安出入境机构已将工作类居留许可注销,并换成了停留签证;如外国人未出境,且工作类居留许可注销一个月内,也可免提供无犯罪记录证明。
7. Physical examination certificate: the verification certificate of physical examination record or health examination certificate issued by the Chinese inspection and quarantine institution shall be issued within 6 months. Application for foreigner Work Permit in China with a valid residence permit is exempted from providing physical examination certificate (the work residence permit for working in China for 90 days or less than 90 days is still required).
7.体检证明:由中国检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书,签发时间均在6个月内。境内申办《外国人工作许可证》持有效的居留许可免提供体检证明(获得来华工作90日以下的工作类居留许可仍需提供)。
8. Employment contract or employment certificate: The Chinese contract shall be provided, which shall be signed and affixed with the official seal of the applicant, and shall not be altered. The employment contract or employment certificate (including the dispatch letter of a multinational company) shall include the working place, working content, salary, working hours in China, position, and seal page (signature). The certificate of employment is applicable to intergovernmental or international organization agreements, chief representatives and representatives of various representative offices in China and overseas contract service providers. The applicable situation of the dispatch letter is that the senior manager and professional management personnel from the headquarters of the multinational company or regional headquarters to work in the domestic subsidiary or branch, which shall be issued by the headquarters or regional headquarters of the multinational company. If the employment certificate (including the letter of dispatch) lacks the necessary contents, a supplementary certificate shall be issued separately. If a multinational company sends managers and other senior managers and professional and technical personnel to the headquarters in China to work in its domestic subsidiaries or branches, it shall submit a letter of dispatch and the employment contract signed with the headquarters of a multinational company in China.
8.聘用合同或任职证明:应提供中文合同,应由申请人签名并加盖单位公章,不得涂改。聘用合同或任职证明(包括跨国公司派遣函)应当包括工作地点、工作内容、薪酬、来华工作时间、职位、盖章页(签字)必要内容。任职证明适用执行政府间、国际组织间协议或协定人员、各类驻华代表处首席代表及代表及境外合同服务提供者。派遣函适用情形为跨国公司总部或地区总部从境外派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职,由跨国公司总部或地区总部出具。任职证明(包括派遣函)如缺少必要内容,需另行出具证明补充说明。跨国公司在华地区总部派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职的,提交派遣函以及与跨国公司在华地区总部签订的聘用合同。
9. Applicants's passport or international travel document: passport or international travel document information page. The passport shall not be valid for less than six months.
9.申请人护照或国际旅行证件:护照或国际旅行证件信息页。护照有效期不得少于6个月。
10. Valid visa or valid residence permit: the passport (or international travel document) visa page, the nearest entry signature page or the residence permit information page.
10.申请人有效签证或有效居留许可:护照(或国际旅行证件)签证页、最近的入境签章页或居留许可信息页。
11. Front bareheaded photo of the applicant within 6 months: recent bareheaded electronic photo, white background, no bezel, complete facial features, clear image, no spots, defects, printing and ink defects. Hats or headscarves are not recommended. If you have to wear them for religious reasons, ensure that it does not cover the entire face of the applicant.
11.申请人6个月内正面免冠照片:近期免冠电子照片,白色背景,无边框,面部特征完整,图像清晰,无斑点、瑕疵、印墨缺陷。不建议戴帽子或头巾等饰物,如因宗教原因不得不戴,应确保其不遮挡申请人整个面部。
12. Cancellation order or resignation certificate: If the applicant changes the employer or post, the foreigner's Work Permit shall first cancel the existing work permit within the validity period. If the contract is normally terminated and the changing company applies for the Work Permit for Foreigners in China within one year, the resignation certificate of the previous company shall be submitted.
12.注销单或离职证明:如申请人变换用人单位或岗位的,《外国人工作许可证》在有效期内,应先行注销现有工作许可。正常解除合同,且1年内在中国境内变换单位申办《外国人工作许可证》的,需提交上家单位的离职证明。
13. Other materials: supplementary materials required by the licensing agency or decision body.
13.其他材料:许可受理机构或决定机构根据需要要求进行补充提供的材料。
