外国人在中国工作之社保公积金相关问题解答

With the rapid development of China's economy and the continuous improvement of its international influence, more and more foreigners choose to come to China to work. People working in China will encounter problems related to social security and provident fund, so foreigners working in China's social security and provident fund problems will be different?

随着中国经济的飞速发展和国际影响力的不断提高,越来越多的外籍人士选择来到中国工作。而在中国工作的人都会遇到社保和公积金的相关问题,那么外国人在中国工作社保和公积金问题会有所不同吗?

I. Do foreigners need to pay social insurance when working in China?

一、 外籍人士在中国工作,是否需要缴纳社保?

A: According to the Interim Measures for Participation in Social Insurance by Foreigners Working in China issued in 2011:

答:根据2011年发布的《在中国境内就业的外国人参加社会保险暂行办法》:

Article 3 Foreigners lawfully recruited by enterprises, public institutions, social organizations, private non-enterprise units, foundations, law firms, accounting firms and other organizations (hereinafter referred to as employers) registered or registered in China shall participate in basic old-age insurance, basic medical insurance, work-related injury insurance, unemployment insurance and maternity insurance according to law. Social insurance premiums shall be paid by the employing unit and the person in accordance with regulations.

第三条 在中国境内依法注册或者登记的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织(以下称用人单位)依法招用的外国人,应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险,由用人单位和本人按照规定缴纳社会保险费。

After concluding an employment contract with an overseas employer, a foreigner who is dispatched to work in a branch or representative office registered or registered within the territory of China (hereinafter referred to as a domestic work unit) shall participate in basic old-age insurance, basic medical insurance, work-related injury insurance, unemployment insurance and maternity insurance according to law, and the domestic work unit and the foreigner himself shall pay social insurance premiums in accordance with regulations.

与境外雇主订立雇用合同后,被派遣到在中国境内注册或者登记的分支机构、代表机构(以下称境内工作单位)工作的外国人,应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险,由境内工作单位和本人按照规定缴纳社会保险费。

It can be seen that for foreigners working in China, the employer must also pay social security for them.

由此可见,对在中国工作的外国人,所属用人单位也是要为其缴纳社保的。

II. do foreigners need to pay the housing provident fund when working in China?

二、 外国人在中国工作,是否需要缴纳住房公积金?

A: Foreigners are not obliged to pay the housing fund. Relevant laws and regulations are as follows:

答: 外国人没有缴纳住房公积金的义务。相关法律法规如下:

1. Housing Provident Fund Administration Regulations (2019)

1. 《住房公积金管理条例》(2019年)

Article 2 These Regulations shall apply to the deposit, withdrawal, use, management and supervision of the housing provident fund within the territory of the People's Republic of China.

第二条 本条例适用于中华人民共和国境内住房公积金的缴存、提取、使用、管理和监督。

The term "housing provident fund" as mentioned in these Regulations refers to the long-term housing reserve funds deposited by state organs, state-owned enterprises, urban collective enterprises, foreign-invested enterprises, urban private enterprises and other urban enterprises, institutions, private non-enterprise units, social organizations (hereinafter referred to as units) and their employees.

本条例所称住房公积金,是指国家机关、国有企业、城镇集体企业、外商投资企业、城镇私营企业及其他城镇企业、事业单位、民办非企业单位、社会团体(以下统称单位)及其在职职工缴存的长期住房储金。

According to the regulations on the management of housing accumulation fund, the National Bureau of Statistics on statistical indicators explanation and the relevant provisions of the ministry of labor security, the regulations of on-service worker, refers to the state organs, state-owned enterprises, urban collective enterprises, foreign investment enterprises, urban private enterprises, institutions, private non-enterprise units, social organizations (hereinafter generally referred to as the unit), and by the unit of all kinds of personnel (not including the foreign and Hong Kong, Macao, Taiwan), and jobs, but due to learning, sick maternity leave (six months) temporarily not work, still by the unit to pay wages. Including the employees who sign the labor contract with the unit or conform to the identification of the labor security department, excluding the employees who have left the unit and still retain the labor relationship.

根据《住房公积金管理条例》、国家统计局有关统计指标解释和劳动保障部有关规定,《条例》所称在职职工,是指在国家机关、国有企业、城镇集体企业、外商投资企业、城镇私营企业及其他城镇企业、事业单位、民办非企业单位、社会团体(以下统称单位)中工作,并由单位支付工资的各类人员(不包括外方及港、澳、台人员),以及有工作岗位,但由于学习、病伤产假(六个月以内)等原因暂未工作,仍由单位支付工资的人员。包括与单位签定劳动合同或符合劳动保障部门认定的形成事实劳动关系的在岗职工,不包括已离开本单位仍保留劳动关系的离岗职工。
