Article 2 of the Interim Measures for Foreigners to Participate in Social Insurance for Employment in China
《外国人在中国就业参加社会保险暂行办法》第二条
Foreigners employment in China, refers to the foreigner employment permit of foreigners, "foreigners work permit", "foreign expert card", hold the foreign permanent residence permit and other employment certificate and foreign residence permit, and hold the foreigner permanent residence permit and legal employment in China of non-Chinese nationality.
在中国就业的外国人，是指依法取得《外国人就业证》的外国人、《外国人工作许可证》、《外国专家证》、持有《外国永久居留证》等就业证件和外国人居留证，以及持有《外国人永久居留证》并在中国合法就业的非中国国籍人员。

企事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织（以下简称用人单位）依法在中国境内注册或注册的外国人，应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险，用人单位和本人应当按照规定缴纳社会保险费。

Article 4

境外雇主派往境内工作单位工作的外国人，应当按照前款的规定，由境内工作单位办理社会保险登记。

The social insurance agency shall regularly inquire to the relevant agencies about the handling of the employment permit for foreigners.
依法办理外国人就业证的机构，应当及时向当地社会保险经办机构通报外国人在中国就业的相关信息。社会保险经办机构应当定期向有关机构查询外国人就业证的办理情况。
